TERMS AND CONDITIONS

By booking a service, the Client agrees to the terms laid out in the following sections. We hope these policies are helpful and instructional as we work together to create beautiful content for your marketing needs.

READINESS OF PROPERTY:

To ensure the best results of the photo/video shoot please be sure the property is ready prior to the scheduled shoot time.

Skyflair will typically be photographing and filming throughout the entire property. Skyflair does not handle any cleaning, dusting, or moving of furniture.  We are unable to physically move or remove property signs. The Client shall ensure that there are no hazards to Skyflair or its employees at the site.

TURNAROUND TIME:

Creating quality content takes time, we work to provide the highest quality media with fast turnaround.

24 hours for photos, Matterport tours, and dedicated property websites

2-3 business day for 30-60 second videos and 2 min cinematic videos

2 business days for twilight photos and virtual staging photos

3-4 business days for 2D floor plans 

Rush delivery is available for image editing and video editing services. Skyflair may not always be able to provide this service.

TRAVEL COST:

In the event that travel is needed outside our service area there will be an additional $100 per hour travel fee. The service area contains Lake, Cook, Dupage, Mchenry, and Kane counties.

3D MATTERPORT VIRTUAL TOURS:

3D Matterport Virtual Tours includes free hosting for 3 months.

After 3 months, 3D Matterport Virtual Tours will be archived and the branded and unbranded links will no longer be active. Extended hosting is available for $60/year for each active scan.

VIDEO POST EDITING:

Skyflair property videos typically follow a format of drone footage followed by property walk-through, with royalty free music. Skyflair will work with the Client to determine specific requirements or creative design choices prior to the shoot.

After content is delivered, Client may request 1 revision to the delivered media within 2 business days of receiving deliverables. After 2 business days, the project will be considered completed and any changes may be subject to additional fees ($100/hour).

CANCELLATION/RESCHEDULING POLICY:

We understand that rescheduling is sometimes necessary. Skyflair will coordinate with clients to reduce the impact of weather, readiness of property, or other unforeseen complications. The Client must notify Skyflair of cancellation 24 hours in advance via email or phone.

Any appointments canceled or changed without 24-hour notice will result in a $100 fee.

Any appointment missed will result in a 50% charge of the total invoice and/or no return of the deposit.

Reschedules will be subject to availability at standard rates.

WEATHER POLICY:

At times, services cannot be fully completed due to weather. In those circumstances, the decision about the shooting is up to the Client in its reasonable discretion. If the Client proceeds with photographs and videos, Skyflair will, to the best of our ability, complete the shoot. If additional outdoor photographs or footage is required, standard rates will apply. We will work with you to determine the best course of action and coordinate rescheduling if there is predictable bad weather.

Reschedules will be subject to availability.

PROPERTY OWNER APPROVAL:

The Client is responsible for obtaining any required approvals from the property owner or any other third parties prior to filming or photographing on-site. Skyflair can provide (at request) a written approval form.

Skyflair makes every effort to maintain the privacy of the property owner's neighbors. All footage is focused on the property being filmed and Skyflair will do its best to respect the privacy of anyone not directly involved.

LIMITED LICENSING RELEASE:

Upon payment of any outstanding balance for this estimate, Skyflair grants client a non-exclusive, commercial license to client for all media delivered. Client may use the provided media for any marketing purposes including uploading to social media, video hosting sites, printed material, or their website. Only the Client has permission to use the delivered media on any electronic or printed forms of distribution.

Builders, Stagers, Designers, or “Third Parties” that wish to include a copyright transfer agreement or contract Skyflair under a work-for-hire agreement must contact Skyflair directly for licensing and fees.

For image integrity and quality control Skyflair asks that photographs and video not be heavily altered once delivered. Clients may crop, re-size, and lightly alter images to suit their needs.

Unless otherwise stated, Skyflair retains the copyright to all media. At no time does this Agreement provide the right to transfer copyright or any other exclusive rights as provided by the Copyright Act 17 U.S.C § 106.

WORK PRODUCT OWNERSHIP:

Any copyrightable works, ideas, discoveries, inventions, patents, products, or other information (collectively, the “Work Product”) developed in whole or in part by Skyflair shall be the exclusive property of Skyflair. Skyflair reserves the right to use video, and photos for advertising, display, publication, or other purposes. All photos, samples, videos, and proofs remain the exclusive property of Skyflair unless waived by amendment to this agreement. Unauthorized use of photographs/video is a copyright violation and will result in the termination of this contract.

LIABILITY WAIVER:

Skyflair and their affiliates shall not be held liable for any accidents, injuries, or damages to persons or property that occur during the service session. The Client releases Skyflair and their affiliates from all liability, claims, and demands arising out of or related to the service session. The Client understands and agrees that Skyflair’s liability shall be limited to the amount paid for services provided.

SEVERABILITY: 

If one or more of the provisions contained in the Agreement is found to be invalid, illegal or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions shall not be affected. Such provisions shall be revised only to the extent necessary to make them enforceable.

PAYMENT / LATE FEES:

 Full payment is due within 24 hours of service being rendered and prior to final deliverables being released. Overdue payments are subject to a $50/month late fee at our discretion. Payments overdue past a month are subject to an additional $50/month or 10%/month late fee whichever is greater. Booking a service with us means you agree and understand the payment schedule on your quote/order and the applicable late fees for non-payment.
